Construction works follow their own rules. Above the EU threshold, the second section of the Construction Contract Procedures (VOB/A) applies, below it the first section. This affects deadlines, value limits and the way suitability is proven. Anyone coming from supplies and services who knows the Public Procurement Regulation (VgV) regularly trips over details here.
One example: the VOB/A counts in calendar days, the VgV does not. The VOB/A has a regulated bid validity period of usually 60 calendar days, the VgV does not. And in cases of extreme urgency in the negotiated procedure without prior call for competition, the VOB/A prescribes at least ten calendar days, while since July 2026 the VgV no longer has any minimum period at all.
On 1 January 2026, the value limits in the first section of the VOB/A were raised significantly. This changes which contracts you actually see put out to tender:
| Procedure | previously | since 1 January 2026 |
|---|---|---|
| Restricted tender without prior call for competition | graded €50,000 to €150,000 | uniformly €150,000 |
| Negotiated award without further justification | €10,000 | €100,000 |
| Direct award | €3,000 | €50,000 |
In practice, this means that a considerable share of smaller construction contracts will in future be awarded without a public tender. The lever lies less in the application itself than in being known to the contracting authorities in your region.
Basis: Section 3a VOB/A in the version applicable since 1 January 2026. Below these limits, contracts may be awarded without a public tender.
With an entry in the prequalification register for construction companies (PQ-VOB), you prove your suitability once a year instead of again with every application. The entry replaces the individual certificates, and the information is only questioned in justified cases. Since July 2026, it has also been the rule that proof via a prequalification system must be accepted.
The principle of dividing contracts into trade lots is the reason medium-sized firms can win large projects at all. Since July 2026, it has had its own section, Section 97a of the Act against Restraints of Competition (GWB). What is new, however, is that for large infrastructure projects contracts may also be awarded to a general contractor for reasons of time. If your business relies mainly on trade lots, you should seek contact with potential general contractors.
