The public sector procures IT using standardised contract templates, the Supplementary Terms and Conditions for the Procurement of IT Services (EVB-IT). Their use is mandatory for federal authorities, and many federal states and municipalities follow suit. There are separate templates for services, the provision of standard software, maintenance, purchase, servicing, cloud, development, systems and framework agreements.
The decisive point for you: these terms are not open to negotiation. Anyone who encloses their own general terms and conditions or deletes clauses risks exclusion for altering the tender documents. Check the liability and warranty provisions before submitting your bid, not afterwards.
Since July 2026, Section 58 of the Public Procurement Regulation (VgV) explicitly names aspects of digital sovereignty as a permissible award criterion. For providers with European hosting, open standards or open source software, this is a noticeable improvement in their starting position. If you have strengths in this area, you should highlight them explicitly in your bid rather than treating them as a matter of course.
A large share of public IT procurement does not run through individual tenders but through framework agreements lasting several years, from which orders are then called off. If you are not part of them, you never even see these contracts. The term is usually no more than four years, and since July 2026 up to eight years for social and other specific services.
In IT, contracting authorities pay particular attention to suitable certifications, especially ISO 27001, complete information on subcontractors, refraining from your own contract terms and references from the public sector where these are required.
