Wage compliance has been mandatory since May 2026

The Federal Collective Wage Compliance Act (Bundestariftreuegesetz) has applied since 1 May 2026 to federal contracts with an estimated contract value of €50,000 or more. For staff-intensive services such as cleaning and caretaking, this is the most important change of the year in practice. The obligation explicitly extends to subcontractors and deployed temporary agency workers as well.

Factor the collectively agreed requirements into your pricing before you submit a bid. A bid that falls below them not only triggers a query under Section 60 of the Public Procurement Regulation (VgV) but, in the event of breaches, can also lead to contractual penalties up to and including exclusion. Since July 2026, the provision also states that the contracting authority should reject an abnormally low bid, no longer merely that it may.

Performance ratios decide your margin

For cleaning services, pricing is driven by performance ratios, that is square metres per hour by room type and type of cleaning. These ratios are set out in the tender documents or derive from the room schedule. Check them carefully: a ratio set too ambitiously by the contracting authority means that the tendered service cannot realistically be delivered in the specified time. This is a classic case for a bidder question before the deadline expires.

Framework agreements and division into lots

Facility services are often tendered as a framework agreement over several years and in lots by property or region. For medium-sized providers, division into lots is the way into contracts that would be out of reach as a complete package. So always check whether you can serve individual lots, even if the overall volume seems too large.

What should be in place before submission

A complete wage compliance declaration, full details of the staff deployed, the required evidence of quality or environmental management and comparable references, so for a hospital, hospital cleaning rather than office cleaning.
